I just noticed that Phaser3d are selling a modification to the MK3 printer as a pre sliced file that you buy and then they email it to you. Is this allowed considering that the printer is open source?

Allowed by whom? Just because the printer is "open source" doesn't mean you can't sell third party bits and pieces (or files) for it.

Absolutely fine as long as it's their own design. If it's a copy or 'remix' of an open-source project then it's down to the project's license.

Creality was a whole other story. The used the Marlin Firmware without distributing the source.

From the pictures it looks like they used Prusa extruder body model and just modified it. If that is the case they are required by the license to provide the source code under the same license. They don't have to do it immediately but they should.

I don't think they designed the entire extruder body by themselves - it looks identical to Prusa model other than a small modification.

If you try and take a cat apart to see how it works, the first thing you have on your hands is a nonworking cat.

And I'm pretty sure there is already a model on Thingiverse to add an insert to your carriage to do the same thing.

My guess is this company basically "stole" an already redesigned extruder right off this very site (there are at least 2 or 3 that have been introduced here, no to mention the creative insert you mentioned.) Ah well... that's the way things roll these days.
